The rule that stops your job isn’t the one you think

Most people plan their renovation hours (裝修時間) in Hong Kong around a law, the Noise Control Ordinance (Cap. 400), and are then blindsided when management shuts the job down on a perfectly legal weekday afternoon. The statute is real and its fines are steep, but it is only the legal floor. The ceiling that actually binds your site is the building’s own house rules. Understand both, in that order, and you can programme a renovation that neither the law nor your neighbours can stop.

The statute: Noise Control Ordinance (Cap. 400)

Renovation noise is governed by the Noise Control Ordinance (Cap. 400), enforced jointly by the Environmental Protection Department (EPD) and the Police. It bites on a renovation in three distinct ways, each with its own time window and enforcer. Treat the statute as the minimum standard and your building’s house rules as the binding limit.

Powered equipment: the 7pm–7am weekday ban

The rule that matters most for a fit-out concerns powered mechanical equipment, drills, breakers, circular saws. This work is prohibited:

  • 7:00pm to 7:00am on weekdays, and
  • at any time on a general holiday, which includes every Sunday ,

unless a Construction Noise Permit (CNP) is in force. Inside the weekday daytime window, roughly 7am–7pm, Monday to Saturday, ordinary powered work needs no EPD permit.

Two points routinely trip people up. Saturday is an ordinary working day under Cap. 400, not a general holiday, so the weekday daytime window applies. And percussive piling always needs a permit and is barred at night and on holidays, though that is a new-build concern rather than a flat fit-out one.

Neighbourhood noise and commercial noise

Two other limbs of the ordinance can catch a project:

  • Neighbourhood noise bites only at night (11:00pm–7:00am) or on a general holiday, and is judged on a reasonable-person “genuine annoyance” test rather than a fixed decibel reading. It is Police-enforced.
  • Commercial or operational noise, from a shop, office or restaurant, not the construction itself, is controlled at any hour against fixed limits and can trigger a Noise Abatement Notice.

The key misconception to correct: ordinary daytime renovation noise inside your own flat is not, by itself, an offence under Cap. 400. What stops a mid-week job is almost always the building’s house rules.

House rules are the real ceiling

The building’s Deed of Mutual Covenant (DMC) and the Owners’ Corporation house rules, made under the Building Management Ordinance (Cap. 344), set the practical limit on site, and they are routinely stricter than the statute. Common house-rule restrictions include Saturday bans, lunch-hour quiet periods, and outright limits on noisy trades to a few hours a day.

Before works on a private estate, expect to complete renovation registration, pay a refundable works deposit, give neighbours advance notice, protect lifts and common areas, and agree debris-moving times.

Who to call: neighbour or night noise → your local Police station; daytime construction noise and commercial-premises noise → the EPD hotline on 2838 3111; evening, night or holiday construction noise → either. Note too that EPD “Designated Areas” in densely built-up districts impose tighter limits on certain equipment, but only during the restricted evening, night and holiday hours, not the daytime window.

法例:《噪音管制條例》(第 400 章)

裝修噪音受《噪音管制條例》(第 400 章)規管,由環境保護署(環保署)警方共同執法。它以三種不同方式約束裝修工程,各有自己的時間範圍和執法者。把法例視為最低標準,把你大廈的守則視為具約束力的上限。

電動設備:平日晚上 7 時至早上 7 時的禁令
